1. Acceptance of Terms

By accessing and using FirstMoves ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FirstMoves is an application designed to help chess players learn and master chess openings. The Service includes:

• Interactive move-by-move opening lessons
• Practice and quiz modes
• Progress tracking and statistics
• Famous games database

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

FirstMoves is suitable for users of all ages. If you are under 18, you represent that you have parental or guardian consent to use the Service and create an account.

4. Free and Premium Plans

Free Plan

The Free plan provides limited access to FirstMoves features at no cost. We reserve the right to modify Free plan features at any time.

Premium Plan

The Premium plan is a paid subscription that provides full access to all features. By subscribing, you agree to:

• Pay the applicable subscription fees
• Automatic renewal at the end of each billing period
• Provide valid payment information

Billing Terms

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your App Store or Google Play Store account settings.

Cancellation and Refunds

You may cancel your Premium subscription at any time. Upon cancellation:

• You retain Premium access until the end of your current billing period
• Your account reverts to the Free plan after the billing period ends
• Refund requests are handled by Apple or Google per their respective policies

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Share your account with others or use another person's account
• Copy, modify, or distribute our content without permission
• Use automated tools to access the Service

6. Intellectual Property

All content on FirstMoves, including text, graphics, logos, and software, is the property of FirstMoves and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Note: Chess move sequences themselves are part of the public domain. Our explanations, analysis, and presentation are protected.

7. Third-Party Services

FirstMoves uses third-party services to operate. These include:

• Supabase: Database and authentication
• RevenueCat: Subscription management (iOS/Android)
• Apple: App Store payments and Sign in with Apple
• Google: Play Store payments

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. FirstMoves is a learning tool and is not a substitute for professional chess instruction.

9. Limitation of Liability

To the maximum extent permitted by law, FirstMoves shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits or data.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless FirstMoves and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party

11. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our sole discretion with reasonable notice.

You may delete your account at any time through account settings.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts located in the State of California.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
